Terms and conditions
For membership of Ladies on Wheels and participation in club activities.
1. Contracting party
Johanna Würzer
Ladies on Wheels
c/o Smartvest AG
Aegeristrasse 27
6300 Zug
Switzerland
E-mail: club@ladiesonwheels.ch
Membership is a contract between the member and Johanna Würzer as operator of the club (the "club management"). There is no association, no general assembly and no voting rights.
2. The club rules are part of the contract
The club rules govern membership, eligible cars, conduct at events, the fees and the consequences of a breach. They form an integral part of these terms. In case of contradiction, the club rules prevail.
3. How the contract is concluded
Registration is online at ladiesonwheels.ch and is an application to join. The contract is concluded when the club management confirms the admission by activating the account. Membership begins when the first annual fee is received.
4. Fees and payment
The fees are set out in Annex 1 section C of the club rules. Payment is made online through the invoice sent to the member, today by card and later also by TWINT. The club does not collect by bank transfer and publishes no IBAN. Payments are processed by Stripe.
The invoice for a membership year is sent one month before it begins and is due on the first day of that year. If it remains unpaid, membership is suspended 14 days later and ends three months after the due date. A last reminder is sent by e-mail before it ends.
5. Term, renewal and cancellation
The membership year starts on 1 March and runs for one year. Membership renews automatically for a further year unless it is cancelled at the latest one month before that year begins.
Cancellation is possible at any time in text form (e-mail is sufficient) and takes effect at the end of the current membership year. Fees already paid are not refunded. If the club management terminates without fault of the member, the fee is refunded pro rata.
There is no statutory right of withdrawal for this contract.
6. Changes
The club management may change the club rules and the fees. Changes are announced by e-mail at least two months before they take effect. A member who does not agree may cancel the membership as of the date the change takes effect; fees already paid are refunded pro rata.
7. Liability
Participation in club activities is at each member's own risk. Liability of the club management is excluded to the extent permitted by law. This exclusion does not apply to damage caused intentionally or through gross negligence (Art. 100 of the Swiss Code of Obligations); mandatory liability, in particular for personal injury, is reserved in every case.
8. Data protection
How members' data is processed is set out in the privacy policy.
9. Governing law and place of jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Zug. Mandatory places of jurisdiction, in particular at the member's domicile as a consumer, are reserved.
